1. Reference Transactions (PayPal – Optional)

If you check out with PayPal and explicitly opt in to faster checkout, PayPal may enable a “reference transaction” to speed up future purchases you initiate. We do not use this to charge you without an order or your authorization.

By visiting the site and/or making a purchase, you agree to this Usage Policy and our incorporated policies: Shipping FAQs, Hassle-Free Returns, Secure Payments, Our Privacy Promise, and Digital Copyright. If you do not agree, please do not use the site.

3. Store Content & Acceptable Use

You may not upload, post, or transmit content that infringes IP rights; is pornographic, obscene, excessively violent; promotes illegal drug use; contains hate or harassment; or encourages unlawful activity. We may remove content or listings that violate these guidelines.

4. Online Store Terms

You must be at least the age of majority in your jurisdiction (or have parental consent). You may not use the site or products for any unlawful purpose or transmit malicious code. Breaches may result in suspension or termination.

5. General Conditions

We may refuse service to anyone at any time. Non-card content you provide may travel unencrypted across networks; card data is handled by our processor as described in Secure Payments. You may not copy, resell, or exploit any portion of the Service without written permission.

6. Accuracy of Information

We aim for accuracy but do not warrant that all information is current, complete, or error-free. You rely on site content at your own risk. Product images/colors are illustrative and can vary by device.

7. Changes to Services & Prices

Prices and availability may change without notice. We may modify or discontinue products or services at any time. Optional post-purchase offers may appear; you can accept or decline.

8. Products & Services

Some items may be offered exclusively online or in limited quantities. We may limit sales by region, customer, or order size at our discretion. Descriptions and pricing are subject to correction (see Section 14).

9. Billing & Account Accuracy

  • We ship to all 50 U.S. states (including AK/HI). No international shipping, no PO Boxes or APO/FPO.

  • Flat shipping fee: $8 per order.

  • Handling: 1–2 business days; Transit: 4–5 business days; Total: 5–7 business days (subject to weather/holidays/carrier conditions).

  • Cutoff: orders before 4:00 PM PT process same business day; after 4:00 PM PT process next business day.

  • If a package is confirmed lost in transit, we reship at no cost. If the address is incorrect, a $8 reship fee applies.

  • Online returns only. Request within 19 days of delivery.

  • Returns: free with prepaid label (no restocking).

  • Exchanges: allowed; $8 exchange-shipping fee.

  • Non-defective items must be brand-new, unused, in original packaging. Defective/damaged-on-arrival items are covered.

12. Payment & Security (Summary)

See Secure Payments. Card and PayPal payments are processed by PayPal over HTTPS; we do not store full card numbers or CVV on our servers.

13. Third-Party Tools & Links

We may provide access to third-party tools “as is” without warranties. Use at your own risk. Third-party links may lead to external sites; we are not responsible for their content or practices.

14. Errors, Omissions & Corrections

We may correct errors or omissions in descriptions, pricing, promotions, shipping charges, or availability at any time, including after you submit an order, and will notify you if a correction affects your order.

15. Prohibited Uses

You may not use the Service to: engage in unlawful activity; harass or discriminate; spread false/misleading information; attempt to breach security or upload malware; collect or misuse personal data; or circumvent technical protections.

16. Intellectual Property & DMCA

All site content is owned by or licensed to The Monterey Music Store. If you believe content infringes your copyright, follow the process on our Digital Copyright page (DMCA, 17 U.S.C. §512).

Your personal information is handled per Our Privacy Promise (includes notice at collection, CPRA rights, cookie choices).

18. Disclaimer of Warranties

The Service and all products are provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law. We do not guarantee uninterrupted, timely, secure, or error-free operation.

19. Limitation of Liability

To the maximum extent permitted by law, The Monterey Music Store is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or products. Our total liability for any claim will not exceed the amount you paid for the order giving rise to the claim.

20. Indemnification

You agree to indemnify and hold harmless The Monterey Music Store and its affiliates, employees, and partners from claims arising from your breach of this Policy or violation of laws or third-party rights.

21. Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

22. Termination

We may suspend or terminate access if you violate this Policy. You remain responsible for amounts due up to the termination date.

23. Entire Agreement

This Usage Policy and the incorporated policies constitute the entire agreement between you and The Monterey Music Store regarding your use of the site and purchases.

24. Governing Law & Venue

This Policy is governed by the laws of the State of California and applicable U.S. federal law. Courts located in Sacramento, California.

25. Changes to This Policy

We may update this Policy at any time. Changes take effect upon posting. Continued use of the site after changes means you accept the revised Policy.
